Terms of Service

The Short Version

Saga Labs, LLC ("Saga," "we," "us") provides a personal AI companion that runs on your device. You pay a monthly subscription, you get access to the app. Your data stays on your device. We don't sell your information. Cancel anytime. By using Saga, you agree to these terms and our Privacy Policy, which is incorporated by reference.

Eligibility

You must be at least 18 years old to use Saga. By using Saga, you represent that you are 18 or older and have the legal capacity to enter into these terms.

Your Account

To use Saga, you need to create an account. You agree to:

  • Provide accurate information when creating your account
  • Keep your account credentials secure and confidential
  • Notify us immediately if you suspect unauthorized access
  • Accept responsibility for all activity under your account

Acceptable Use

You agree to use Saga responsibly. You will not:

  • Use Saga for any illegal activities or to violate others' rights
  • Attempt to reverse engineer, decompile, or extract source code from the app
  • Copy, redistribute, or resell Saga or any part of it
  • Use Saga to generate harmful, abusive, or deceptive content
  • Attempt to circumvent usage limits or billing
  • Interfere with or disrupt the service or servers
  • Use automated systems to access Saga without permission

Subscriptions & Billing

  • Subscriptions are billed monthly in advance
  • You authorize us to charge your payment method automatically each billing cycle
  • You can cancel anytime from your account settings
  • Cancellation takes effect at the end of your current billing period
  • We don't offer refunds for partial months or unused time
  • We may change prices with 30 days notice; continued use constitutes acceptance
  • If payment fails, we may suspend access until payment is received

Your Content

Everything you create in Saga belongs to you. Your conversations, journal entries, and notes are stored locally on your device. We don't claim any ownership rights to your content. Account information (email, usage data for billing) is stored on our servers as described in our Privacy Policy.

You're responsible for backing up your local data. Since your content is stored on your device, we cannot recover it if lost. We recommend regular backups.

Our Intellectual Property

Saga, including the app, website, branding, and all related technology, is owned by Saga Labs, LLC and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use Saga for personal purposes. This license does not include the right to:

  • Modify, adapt, or create derivative works of Saga
  • Use our trademarks, logos, or branding without permission
  • Sublicense or transfer your access to others

AI Responses

Saga uses AI to generate responses. While we strive for accuracy and helpfulness, you understand that:

  • AI responses are not professional advice (medical, legal, financial, therapeutic, or otherwise)
  • AI can make mistakes, hallucinate facts, or provide inaccurate information
  • You should verify important information independently
  • You are responsible for how you use and act on AI suggestions
  • Saga is not a substitute for professional help when you need it

Saga is not a mental health service. While Saga can be a helpful tool for reflection and self-understanding, it is not a replacement for therapy, counseling, or psychiatric care. If you are experiencing a mental health crisis, please contact a mental health professional or crisis service immediately.

Service Availability

We aim for high availability but cannot guarantee uninterrupted service. The app requires an internet connection to process AI responses. We may need to perform maintenance, updates, or make changes to the service. We'll try to provide advance notice for planned downtime when possible.

We are not liable for service interruptions caused by circumstances beyond our reasonable control, including but not limited to: natural disasters, internet outages, third-party service provider failures (such as AI providers), government actions, or other force majeure events.

Warranty Disclaimer

SAGA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SAGA WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAGA LABS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF SAGA. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO SAGA SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50 USD.

Indemnification

You agree to indemnify and hold harmless Saga Labs, LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of Saga, your violation of these terms, or your violation of any third-party rights.

Termination

You can stop using Saga at any time by canceling your subscription and deleting the app. We may suspend or terminate your account if you violate these terms or engage in abusive behavior. Upon termination, your license to use Saga ends immediately. Your local data remains on your device.

The following sections survive termination: Your Content, Our Intellectual Property, AI Responses, Warranty Disclaimer, Limitation of Liability, Indemnification, and Governing Law & Disputes.

Changes to Terms

We may update these terms from time to time. We'll notify you of material changes via email or in-app notification at least 30 days before they take effect. Your continued use of Saga after changes take effect constitutes acceptance of the updated terms. If you don't agree to the changes, you may cancel your subscription before they take effect.

Governing Law & Disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved as follows:

  • First, contact us — Many issues can be resolved quickly by emailing support@saga.chat
  • Informal resolution — We agree to attempt good-faith negotiations for 30 days before pursuing formal action
  • Arbitration — Any unresolved disputes shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association
  • Small claims exception — Either party may bring individual claims in small claims court if the claim qualifies
  • Class action waiver — You agree to resolve disputes individually and waive any right to participate in class actions

If you are located in the European Union, nothing in these terms affects your statutory rights as a consumer under applicable EU law.

If any part of this arbitration provision is found unenforceable, the remaining portions shall remain in effect. If the class action waiver is found unenforceable, the entire arbitration provision shall be void, and disputes shall be resolved in the state or federal courts of Delaware.

General

  • These terms constitute the entire agreement between you and Saga Labs, LLC regarding your use of Saga
  • By creating an account, subscribing, or using Saga, you acknowledge that you have read, understood, and agree to be bound by these terms. Electronic acceptance is legally binding.
  • If any provision is found unenforceable, the remaining provisions continue in effect
  • Our failure to enforce a right does not waive our ability to enforce it later
  • You may not assign or transfer these terms without our consent
  • We may send legal notices to the email address associated with your account. You may send legal notices to legal@saga.chat or by mail to our address below
